The Legal Landscape of CBD By legal definition, hemp is a cannabis plant containing no more than 0.3% THC by dry weight, whereas marijuana is defined as cannabis with more than 0.3% THC.

The 2018 Farm Bill removed hemp from the Controlled Substances Act’s definition of marijuana, legalizing hemp-derived products.

However, the FDA retains authority over hemp products under the Federal Food, Drug, and Cosmetic Act (FD&C Act), meaning these products must meet the same requirements and standards as other FDA-regulated items.

States vary in their stance on hemp-derived products; while some align with the federal threshold of 0.3% THC, others have different limits, and a few have legalized marijuana entirely.
